General rules
1. Conclusion and modification of the Contract
1.1. The Service Provider reserves the right to unilaterally amend the GTC in force, in order to ensure full compliance with any legislation applicable to its activities that may change from time to time.
1.2. In response to a written offer request from the Contracting Party, the Service Provider will send an offer. The offer sent does not yet qualify as a Contract.
1.3. Based on the Contracting Party’s written order (booking), the Pre-Contract comes into effect on the day the Service Provider sends its written confirmation. Thereafter, the Service Provider puts the Contract into effect under the terms set out in the second written confirmation, containing the hotel’s booking reference, that is sent out.
1.4. Amendment and/or supplementation of the Contract requires a written agreement signed by the Parties.
2. Basic provisions
2.1. Pursuant to Section 8:1 (1) point 3 of the Hungarian Civil Code (“Civil Code”), only a natural person acting outside the scope of their profession, independent occupation, or business activity qualifies as a consumer. Under the Civil Code, businesses (including SMEs) do not qualify as consumers.
2.2. Matters not regulated in these Terms, as well as the interpretation of these Terms, are governed by Hungarian law, with particular regard to Act V of 2013 on the Civil Code (“Civil Code”), Act CVIII of 2001 on certain issues of electronic commerce services and information society services (“E-Commerce Act”), and Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses. The mandatory provisions of the relevant legislation apply to the Parties even without a specific stipulation to that effect.
2.3. These Terms are effective from the date of issue and remain in force until revoked. The Service Provider is entitled to unilaterally amend the Terms. The Service Provider will publish any amendments on the website 11 (eleven) days before they enter into force. By using the website, users accept that all rules relating to the use of the website automatically apply to them.
2.4. The Service Provider reserves all rights with respect to the website, any part thereof, the content appearing on it, and the distribution of the website. It is prohibited to download, electronically store, process, or sell the content appearing on the website, or any part thereof, without the Service Provider’s prior written consent. The documents listed in Section 14, which may be freely downloaded, are excluded from this restriction.
2.5. Special status of micro, small and medium-sized enterprises (hereinafter “SMEs”): Pursuant to applicable legislation (Government Decree 151/2003 and Act CLV of 1997), businesses qualifying as SMEs are entitled, in connection with purchases made in the Webshop, exclusively to statutory warranty rights and the right to initiate conciliation board proceedings, provided that they purchase the product as the final user, outside the scope of their profession, independent occupation or business activity, within the framework of retail sale. Other rights available to consumers (such as the 14-day right of withdrawal without justification) do NOT apply to SMEs.
3. Purchase of gift vouchers
3.1. By making a purchase on the website, the User declares that they have read and accept the terms of these GTC and the Privacy Policy published on the website, and consent to the related data processing.
3.2. During the purchase, the User is obliged to provide their own, accurate data. If false data, or data belonging to another person, is provided during the purchase, the resulting electronic contract is void. The Service Provider excludes its liability if the User uses its services under another person’s name or with another person’s data.
3.3. The Service Provider bears no liability whatsoever for any delivery delay or other problem or defect attributable to data provided incorrectly and/or inaccurately by the User.
4. Range of purchasable products and services, prices
Provisions relating to the webshop
4.1.1. The displayed products may only be ordered online. Prices displayed for products are stated in Hungarian forints and include statutory VAT.
4.1.2. In the webshop, the Service Provider provides a detailed description of the product’s name and description, and displays photos of the products. The color and pattern of the products may differ slightly from what is shown in the picture. The images shown on the product page of virtual products (e.g., gift vouchers) are illustrative only.
Hotel prices
4.2.1. If a promotional price is introduced, the Service Provider will inform Users in full about the promotion and its exact duration.
4.2.3. If, despite the Service Provider’s utmost care, an erroneous price appears on the Webshop interface, in particular a manifestly incorrect price, e.g., one significantly differing from the product’s well-known, generally accepted or estimated price, or a price of “0” HUF or “1” HUF appearing due to a system error, the Service Provider is not obliged to deliver the product at the erroneous price, but may instead offer delivery at the correct price, upon becoming aware of which the Customer may withdraw from their intention to purchase.
4.2.3. In the case of an erroneous price of the magnitude described in point 4.4, there is a striking disproportion between the actual and the displayed price of the product, which an average consumer should also immediately notice. Under Act V of 2013 on the Civil Code (“Civil Code”), a contract is formed through the mutual and concurring expression of the will of the parties. If the parties cannot agree on the contractual terms, i.e., there is no statement expressing the mutual and concurring will of the parties, then no validly concluded contract exists from which rights and obligations could arise. Accordingly, an order confirmed at an erroneous/incorrect price shall be regarded as a void contract.
4.2.4. The Service Provider sets out in the Contract the prices of the services used, corresponding to the special, individual conditions. Given that prices are established with regard to all services used by the Guest, the Contracting Party acknowledges that the Service Provider reserves the right to change the unit price in the event the Contract is amended.
4.2.5. The price specified in the confirmation does not include the tourism tax (IFA); information on the current rate of the tourism tax is available on the Prices page. In the event of a change in the applicable statutory rate of the tourism tax, the Service Provider reserves the right to apply the change.
4.2.6. The Service Provider publishes the prices of its catering services not included in the Contract on the menu and drinks list used in the respective catering units.
4.2.7. The daily opening hours of the Service Provider’s units are published on the www.puchner.hu website. At the Contracting Party’s specific request, the Service Provider provides extended opening hours in all of its units for a fee, the terms of which are set out in the Contract.
Special conditions relating to accommodation services
4.3.1. On the day of arrival, rooms are available to the Contracting Party after 15:00. The Service Provider always strives to make rooms available as early as possible; however, in some cases, through no fault of its own, it may only be able to provide the rooms at a later time.
4.3.2. If, on the final day of the period specified in the Contract, the Guests do not vacate the room by 11:00, the Service Provider is entitled to charge, as a contractual penalty, the applicable late check-out fee between 11:00 and 15:00, and 100% of the daily room rate after 15:00.
4.3.3. Upon request, depending on hotel occupancy, the Service Provider provides late check-out for a surcharge, the amount and conditions of which are set out in the Contract.
4.3.4. Upon request, the Service Provider provides free-of-charge use of a luggage room designated for this purpose, for the storage of luggage, subject to available capacity.
4.3.5. In the event of unforeseeable technical obstacles arising from causes beyond the hotel’s control, the Service Provider reserves the right to change the accommodation provided.
4.3.6. Unlimited use of the wellness facilities and discounted admission to the baths included in the room rate is valid, within their official opening hours, free of charge all day on the day of arrival, and until 11:00 on the day of departure.
Contents of the room rate
4.4. The Contract (written confirmation) concluded between the Service Provider and the Contracting Party sets out the contents of the room rate.
5. Ordering process
Webshop order
5.1.1. The User may begin the purchase without registration.
5.1.2. The User sets the quantity of the product(s) they wish to purchase.
5.1.3. The User places the selected products in the cart. The User may view the contents of the cart at any time by clicking the “cart” icon.
5.1.4. If the User does not wish to purchase any further products, they check the quantity of the product to be purchased. The contents of the cart can be deleted by clicking the “delete – X” icon. The User clicks the “update/update cart” icon to finalize the quantity.
5.1.5. The User selects the method of payment, the types of which are as follows:
- By bank transfer: The User is obliged to transfer the consideration for the ordered products to the bank account indicated in the confirmation email within 3 days. Once the amount has been credited to the Service Provider’s bank account, the User is entitled to take delivery of the product(s) in the manner specified by them.
- Online by bank card: The User has the option to pay the total value of the order online, by bank card, through the secure payment system of the financial service provider used by the Service Provider (OTP Bank).
- By SZÉP card: The User has the option to pay the total value of the order with a SZÉP card, through the secure payment system of the financial service providers used by the Service Provider (OTP, MKB/MBH, K&H).
5.1.6. If an error or omission occurs in the webshop with respect to the products or prices, we reserve the right to make corrections. In such a case, we will inform the customer immediately after identifying and correcting the error of the new data. The User may then either confirm the order once more or withdraw from the contract.
5.1.7. The total amount payable, based on the order summary and confirmation letter, includes all costs.
5.1.8. After entering the data, the User can submit their order by clicking the “submit order/send order” button; before doing so, however, they may once more check the data provided, and may also add a comment to the order or notify us by email of any other wish related to the order.
5.1.9. By placing the order, the User acknowledges that a payment obligation arises.
5.1.10. Correction of data entry errors: Before completing the ordering process, the User can always go back to the previous stage, where the entered data can be corrected. In detail: during the order, it is possible to view and modify the contents of the cart; if the cart does not contain the quantity to be ordered, the User can enter the desired quantity in the data entry field found in the quantity column, and then press the “update/update cart” button. If the User wishes to delete products from the cart, they click the “X” “delete” button. During the order, the User has continuous opportunity to correct/delete the data entered.
5.1.11. The User receives a confirmation by email after sending the order. If this confirmation does not reach the User within a reasonable time depending on the nature of the service, but no later than 48 hours from the sending of the User’s order, the User is released from the offer or contractual obligation. The order and its confirmation are considered to have reached the Service Provider or the User, respectively, when it becomes accessible to them. The Service Provider excludes its liability for confirmation if the confirmation does not arrive in time because the User provided an incorrect email address during registration, or because the mailbox associated with their account is unable to receive messages due to being full.
5.1.12. The User acknowledges that the confirmation referred to in the previous point is merely an automatic confirmation and does not create a contract. The contract is formed when, following the automatic confirmation referred to in the previous point, the Service Provider notifies the User in a further email of the details of the order and its expected performance. Upon receipt of this written confirmation, the guest accepts the payment, modification and cancellation terms set out therein.
Methods of payment for hotel services
5.2.1. The Service Provider requires payment of the consideration for the services provided to the Contracting Party at the latest following use of the service, prior to departure from the facility, but may, within the framework of an individual agreement, also allow subsequent payment.
5.2.2. In order to guarantee the use of the service in accordance with the Contract and the settlement of the consideration, the Service Provider may request payment of an advance/deposit for part or the full amount of the services under the Contract.
5.2.3. The Service Provider may also make the conclusion of the Contract conditional upon the payment of a deposit of a specified amount.
5.2.4. The method of payment may be:
- Cash
- Cashless payment instruments – bank cards of the type displayed and accepted by the Service Provider
- Széchenyi Recreation Card (OTP, K&H, MKB/MBH)
- Bank transfer initiated by the Contracting Party, in the previously agreed currency and within the payment deadline. If settlement takes place in a currency other than that specified in the Contract, the conversion will be based on the MNB (National Bank of Hungary) exchange rate applicable on the day the amount is credited to the Service Provider’s bank account.
6. Processing and fulfillment of orders
Webshop orders
6.1.1. Orders are processed during opening hours. It is also possible to place an order outside the times designated for order processing; if this occurs after business hours, the order will be processed on the following day. The Service Provider’s customer service will in every case confirm electronically when it will be able to fulfill the order.
6.1.2. The general delivery deadline is 2–3 business days from the conclusion of the contract.
6.1.3. Under the sales contract, the Service Provider is obliged to transfer ownership of the item, and the User is obliged to pay the purchase price and take delivery of the item.
6.1.4. If the seller is a business and the buyer is a consumer, and the seller undertakes to deliver the item to the buyer, the risk of loss passes to the buyer when the buyer or a third party designated by the buyer takes possession of the item. The risk passes to the buyer upon handover to the carrier, if the carrier was engaged by the buyer, provided that the carrier was not recommended by the seller.
6.1.5. If the seller is a business and the buyer is a consumer, in the absence of a different agreement between the parties, the seller (under these GTC: the Service Provider) is obliged to make the item available to the buyer (User) without delay after the conclusion of the contract, but no later than within thirty days.
6.1.6. In the event of delay by the Service Provider, the User is entitled to set an additional deadline. If the seller fails to perform within the additional deadline, the buyer is entitled to withdraw from the contract.
6.1.7. The User is entitled to withdraw from the contract without setting an additional deadline if
- a) the Service Provider has refused to perform the contract; or
- b) the contract should have been performed, according to the parties’ agreement or the recognizable purpose of the service, within the specified performance time – and not at any other time.
6.1.8. If the Service Provider is unable to fulfill its obligation under the contract because the product specified in the contract is not available, it is obliged to inform the User of this without delay and to refund without delay any amount paid by the User.
Invoicing of hotel services
6.2.1 In the case of advance payment, the Service Provider issues an advance invoice in every case for services not yet used.
6.2.2. For services rendered, in accordance with Hungarian legislation and the Contract, the Service Provider issues an invoice that itemizes the services and consumption used, serving to settle the consideration for the services performed under the Contract, as well as any additional (extra) consumption used by the Contracting Party or the Guest.
6.2.3. In accordance with applicable legislation, in the case of bank transfer, the invoice may be issued in the name of the party initiating the transfer.
6.2.4. The Service Provider records, in its computer system, both the services included in the Contract and any extra consumption used in every case, and prepares a written document to certify performance. The person(s) designated in the Contract by the Contracting Party are obliged to acknowledge the consumption by signing the document prepared thereof.
6.2.5. If the currency of the price recorded in the Service Provider’s confirmation is not HUF, then on the invoice issued by the Service Provider, the amount payable will be indicated in HUF as well as in the currency of the confirmation – together with the applicable exchange rate.
6.2.6. Settlement of the invoice issued by the Service Provider by the Contracting Party takes place in the currency of the confirmation. If the transfer is not made in the currency indicated in the confirmation, the conversion will be based on the MNB exchange rate applicable on the day the amount is credited to the Service Provider’s bank account.
6.2.7. When settling the invoice, bank charges related to the transfer of the total invoice amount are borne by the Contracting Party.
6.2.8. Following the issuance of the invoice, the Service Provider is not able to modify the billing name and address.
7. Right of withdrawal
For the webshop
7.1. Pursuant to Directive 2011/83/EU of the European Parliament and of the Council, and Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, the Consumer may withdraw from the contract and return the ordered product without justification within 14 days of receiving the ordered product. In the absence of this notice, the Consumer is entitled to exercise the right of withdrawal for up to 1 year. If the Service Provider provides this information after the 14-day period from the date of receipt of the product or conclusion of the contract has elapsed, but within 12 months, the withdrawal period will be 14 days from the date such information is communicated.
7.2. The Consumer may exercise the right of withdrawal through an unambiguous statement to that effect, or by using the model withdrawal statement set out in Annex 2 of Government Decree 45/2014 (II. 26.).
7.3. The period available for exercising the right of withdrawal expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes delivery of the product.
7.4. The Consumer may also exercise the right of withdrawal during the period between the date of conclusion of the contract and the date of receipt of the product.
7.5. The cost of returning the product must be borne by the consumer; the business has not undertaken to bear this cost.
7.6. When exercising the right of withdrawal, the Consumer bears no costs other than the cost of returning the product.
7.7. The right of withdrawal does not apply to the Consumer in the case of a non-prefabricated product manufactured on the consumer’s instructions or at their express request, or in the case of a product that has been clearly personalized for the consumer.
7.8. The consumer likewise cannot exercise the right of withdrawal
- a) in the case of a contract for the provision of services, after the service has been fully performed, if the business began performance with the consumer’s express prior consent, and the consumer acknowledged that they would lose their right of termination once the service had been fully performed;
- b) in respect of a product or service whose price depends on fluctuations in the financial market that cannot be influenced by the business and which may occur even during the period available for exercising the right of withdrawal;

- h) in respect of the sale of a sealed audio or video recording or computer software, if the consumer has unsealed the packaging after delivery;
- i) in respect of newspapers, periodicals and magazines, with the exception of subscription contracts;
- j) in the case of contracts concluded at a public auction;
- k) in the case of a contract for accommodation other than for residential purposes, transport, car rental, catering, or services related to leisure activities, if the contract specifies a fixed date or period for performance;
- l) in respect of digital content not supplied on a tangible medium, if the business began performance with the consumer’s express prior consent, and the consumer, together with giving this consent, declared that they acknowledged that they would lose their right of withdrawal once performance had begun.
7.9. Following the return of the product and/or receipt of the withdrawal statement, the Service Provider will refund the amount paid to the Consumer without delay, but no later than 14 days from the date on which it became aware of the withdrawal, in accordance with the legislation cited above.
7.10. For the refund, we use the same payment method as that used in the original transaction, unless the Consumer expressly consents to the use of a different payment method; the Consumer will not be charged any additional costs as a result of using this refund method.
7.11. The Consumer is obliged to return the goods without undue delay, but in any case no later than 14 days from the date on which the notice of withdrawal from the contract was sent to the Service Provider, or to hand them over at the Service Provider’s address.
7.12. In the case of withdrawal made in writing, it is sufficient for the Consumer to send the withdrawal statement within 14 days.
7.13. The Consumer complies with the deadline if the product(s) are sent back or handed over before the expiry of the 14-day period. The return will be considered to have been made within the deadline if the consumer sends the product before the deadline expires.
7.14. The consumer bears only the direct cost of returning the product, unless the business has undertaken to bear this cost.
7.15. The Service Provider may withhold the refund until it has received the goods back, or until the Consumer has provided proof that the goods have been sent back, whichever is earlier.
7.16. Should the Consumer wish to exercise the right of withdrawal, they may notify us in writing at any of the Service Provider’s contact details (even using the enclosed form), by telephone, or even in person. In the case of written notice sent by post, the date of posting will be taken into account, and in the case of notice by telephone, the time of the telephone notification. In the case of notice sent by post, the Service Provider accepts notice sent as a registered item or a parcel. The Consumer may return the ordered product to the Service Provider by post or with the help of a courier service.
7.17. The consumer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the product.
7.18. Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses is available here.
7.19. Directive 2011/83/EU of the European Parliament and of the Council is available here.
7.20. The Consumer may also contact the Service Provider with any other complaint using the contact details found in these Terms.
7.21. The right of withdrawal is available only to Users who qualify as consumers under the Civil Code.
7.22. The right of withdrawal is not available to a business, i.e., a person acting within the scope of their profession, independent occupation or business activity.
7.23. Procedure for exercising the right of withdrawal:
- 7.23.1. Should the Consumer wish to exercise the right of withdrawal, they are obliged to notify the Service Provider of their intention to withdraw using the Service Provider’s contact details.
- 7.23.2. The Consumer exercises the right of withdrawal within the deadline if they send their withdrawal statement before the expiry of the 14th day from receipt of the product. In the case of withdrawal made in writing, it is sufficient to send the withdrawal statement within 14 days. In the case of notice sent by post, the date of posting will be taken into account; in the case of notice by email or fax, the time the email or fax was sent will be taken into account. The model withdrawal statement can be found at the end of these GTC, among the downloadable documents, or it may be submitted via our online form.
- 7.23.3. In the event of withdrawal, the Consumer is obliged to return the ordered product to the Service Provider’s address without delay, but no later than 14 days from the date the withdrawal statement was communicated. The deadline is deemed to have been complied with if the product is sent before the expiry of the 14-day deadline (i.e., it does not need to arrive within 14 days). The customer bears the costs arising in connection with the return of the goods due to the exercise of the right of withdrawal.
- 7.23.4. However, the Service Provider is not obliged to reimburse the Consumer for any additional costs resulting from choosing a mode of delivery other than the cheapest standard mode of delivery offered by the Service Provider. The Consumer also exercises the right of withdrawal during the period between the date of conclusion of the contract and the date of receipt of the product.
- 7.23.5. In the case of the purchase of several products, if the individual products are delivered at different times, the consumer may exercise the right of withdrawal within 14 days of receipt of the last delivered product, or, in the case of a product consisting of several items or pieces, of the last delivered item or piece.
7.24. We inform our corporate partners that program tickets and digital services are not subject to the mandatory warranty under Government Decree 151/2003.
7.25. Pursuant to Government Decree 45/2014 (II. 26.), the 14-day right of withdrawal without justification is available exclusively to Consumers (natural persons). Business associations, sole proprietors and other legal entities (SMEs) may not exercise the right of withdrawal without justification, even if the product was not purchased for their main business activity.
7.24. Hotel cancellation conditions

7.24.1 Individual Puchner promotion, non-cancellable conditions:
The room reservation becomes final and guaranteed upon receipt of a 100% deposit.
- Please transfer the deposit within 1 day following the confirmation. • Failure to pay the deposit does not automatically result in the cancellation of the room reservation. Our contractual penalty terms remain applicable in this case as well.
- This is a non-cancellable booking condition; in the event of cancellation of the reservation, no-show, or early departure following arrival, 100% of the accommodation fee will be charged as a contractual penalty, and therefore we are not able to refund the amount.
- Modification is possible under the modification terms set out in the confirmation.
7.24.2 Peak-season cancellation conditions:
A 50% deposit is required for the room reservation.
- Please transfer the deposit within 7 days following the confirmation.
- Failure to pay the deposit does not automatically result in cancellation of the room reservation.
- If cancellation of the reservation is notified to us 30–7 days before arrival, a voucher will be issued for 75% of the amount paid, valid for use within one year. 25% of the amount paid will be charged as a contractual penalty. If you wish to move the reservation to a later date instead, this can be done in accordance with the modification terms.
- In the event of cancellation within 2–6 days before arrival, 50% of the amount paid will be charged as a contractual penalty, and therefore we are not able to refund the amount. A voucher will be issued for 50% of the amount paid, valid for use within one year.
- In the event of cancellation on the day before or on the day of arrival, 100% of the accommodation fee is payable as a contractual penalty, i.e., the deposit paid will be charged as a contractual penalty, and a penalty invoice will subsequently be issued for the remaining amount, payable within 3 business days.
- In the case of no-show or early departure following arrival, 100% of the accommodation fee is payable.
7.24.3 Cancellation conditions for coupon bookings:
We can accept cancellation of the guaranteed and exclusive room reservation without penalty up to the 7th day before arrival, exclusively in writing. In the event of cancellation within 7 days, 50% of the accommodation fee or the deposit paid will be invoiced as a contractual penalty. In the case of no-show or early departure following arrival, 100% of the accommodation fee is payable.
1.5 Modification is possible under the terms set out in the Contract.
7.24.5. Modification fees:
The reservation may be modified as follows:
An already finalized and confirmed reservation may be moved to a different date, or the number of guests or room type may be modified, subject to the currently applicable prices and available capacity, upon payment of the following fees:
If the reservation was made using a promotional code or another discount (with the exception of the loyalty program discount), the discount cannot be carried over to the new, modified reservation in the event of any modification to the reservation’s parameters.

8. Warranty
Defective performance
The obligor performs defectively if the service, at the time of performance, does not meet the quality requirements set out in the contract or by law. The obligor does not perform defectively if the entitled party was aware of, or should have been aware of, the defect at the time the contract was concluded.
In a contract between a consumer and a business, any stipulation departing from this chapter’s provisions on statutory warranty and guarantee to the detriment of the consumer is void.
Statutory warranty
8.1. In which cases may the User exercise their right of statutory warranty?
The User may assert a statutory warranty claim against the Service Provider in accordance with the rules of the Civil Code in the event of defective performance by the Service Provider. The statutory warranty rules under the Civil Code apply to the performance of our services (e.g., sale of virtual gift vouchers). We inform our customers that, under applicable legislation, the services we provide are not subject to a mandatory guarantee.
8.2. What rights does the User have based on their statutory warranty claim?
The User may – at their choice – assert the following statutory warranty claims: they may request repair or replacement, unless fulfilling the claim chosen by the User is impossible or would involve disproportionate additional costs for the business compared to fulfilling another claim. If repair or replacement was not requested, or could not be requested, the User may request a proportionate reduction of the consideration, or may repair the defect, or have it repaired by another party, at the business’s expense, or may – as a last resort – withdraw from the contract. The User may switch from the chosen warranty right to another, but shall bear the cost of doing so, unless it was justified, or the business gave cause for it.
8.3. Within what deadline may the User assert their statutory warranty claim?
The User is obliged to report the defect immediately after its discovery, but no later than within two months of discovering the defect. Please note, however, that statutory warranty rights may no longer be exercised beyond the two-year limitation period from performance of the contract.
8.4. Against whom may the statutory warranty claim be asserted?
The User may assert their statutory warranty claim against the Service Provider.
8.5. What other conditions apply to the exercise of statutory warranty rights?
Within one year of performance, there is no other condition for asserting a statutory warranty claim beyond reporting the defect, if the User proves that the product or service was provided by the business operating the webshop. However, after one year has elapsed from performance, the User is obliged to prove that the defect they identified already existed at the time of performance.
Product warranty
8.6. In which cases may the User exercise the right of product warranty?
In the event of a defect in movable property (product), the User may – at their choice – assert either a statutory warranty or a product warranty claim.
8.7. What rights does the User have based on a product warranty claim?
As a product warranty claim, the User may only request the repair or replacement of the defective product.
8.8. In which cases is a product considered defective?
A product is defective if it does not meet the quality requirements in effect at the time it was placed on the market, or if it does not have the characteristics described by the manufacturer.
8.9. Within what deadline may the User assert a product warranty claim?
The User may assert a product warranty claim within two years of the product being placed on the market by the manufacturer. Once this deadline has expired, this right is forfeited.
8.10. Against whom, and subject to what other conditions, may a product warranty claim be asserted?
A product warranty claim may only be asserted against the manufacturer or distributor of the movable property. When asserting a product warranty claim, the User must prove the defect of the product.
8.11. Under what circumstances is the manufacturer (distributor) exempt from its product warranty obligation?
The manufacturer (distributor) is exempt from its product warranty obligation only if it can prove that:
– it did not manufacture or place the product on the market in the course of its business activity, or
– the defect was not identifiable, according to the state of science and technology, at the time it was placed on the market, or
– the defect of the product results from the application of a law or mandatory official regulation.
It is sufficient for the manufacturer (distributor) to prove one of these grounds for exemption.
Please note that you may not assert a statutory warranty and a product warranty claim simultaneously, in parallel, for the same defect. However, if a product warranty claim is successfully asserted, the statutory warranty claim for the replaced product or repaired part may be asserted against the manufacturer.
8.12. The Service Provider bears no warranty liability for damage arising after the transfer of risk from improper or negligent handling, excessive use, or other effects deviating from those specified, or otherwise from improper use of the products.
8.13. If a consumer asserts a replacement claim due to a defect in the consumer product within three business days of purchase (commissioning), the Service Provider is obliged to replace the consumer product, provided that the defect prevents the product’s intended use.
9. Procedure in the event of a warranty claim
9.1. In a contract between a consumer and a business, the agreement of the parties may not depart from the provisions of the decree to the detriment of the consumer.
9.2. The consumer bears the burden of proving that the contract was concluded.
9.3. Costs relating to the fulfillment of the warranty obligation are borne by the Service Provider (Section 6:166 of the Civil Code).
9.4. The Service Provider is obliged to draw up minutes regarding any warranty claim reported to it by the consumer.
9.5. A copy of the minutes must be made available to the consumer without delay, in a verifiable manner.
9.6. If the Service Provider is unable to state, upon receipt of the consumer’s warranty or guarantee claim, whether it can be fulfilled, it must notify the consumer of its position – including, if the claim is rejected, the reasons for the rejection and the option of turning to the conciliation board – within five business days, in a verifiable manner.
9.7. The Service Provider is obliged to keep the minutes for three years from the date they were drawn up, and to present them to the supervisory authority upon request.
9.8. The Service Provider must endeavor to carry out the repair or replacement within fifteen days at the most.
10. Miscellaneous provisions
Webshop
10.1.1. The Service Provider is entitled to use a contributor to fulfill its obligation. It bears full liability for any unlawful conduct by such contributor, as if it had committed the unlawful conduct itself.
10.1.2. If any part of these Terms becomes invalid, unlawful or unenforceable, this does not affect the validity, lawfulness and enforceability of the remaining parts.
10.1.3. If the Service Provider does not exercise a right due to it under the Terms, this failure to exercise the right shall not be considered a waiver of that right. Any waiver of a right is valid only if made by an express written statement to that effect. The fact that the Service Provider does not strictly insist, on one occasion, on any material condition or stipulation of the Terms does not mean that it waives its right to strictly insist on compliance with that condition or stipulation in the future.
10.1.4. The Service Provider and the User shall attempt to resolve their disputes amicably.
10.1.5. The Parties acknowledge that the Service Provider’s webshop operates in Hungary, and is also maintained there. Since the website may also be visited from other countries, users expressly acknowledge that Hungarian law is the governing law in the relationship between the user and the Service Provider. If the user is a consumer, then, pursuant to Section 26 (1) of the Hungarian Code of Civil Procedure, the court having jurisdiction over the consumer’s domestic place of residence has exclusive jurisdiction over any disputes arising from this contract against the defendant (consumer).
The Service Provider’s contractual rights and obligations
10.2.1. The Service Provider reserves the right to request a payment guarantee from the Contracting Party or its guests upon arrival for basic and extra services that have not been prepaid.
10.2.2. If the Guest fails to fulfill their obligation to pay for extra services used, or for services ordered under the Contract at the Guest’s expense, the Service Provider is entitled to assert this claim directly against the Contracting Party, as guarantor.
10.2.3. The Service Provider’s security service is entitled to remove from the premises – while respecting personal rights – any person who jeopardizes the calm and safety of any of the Service Provider’s activities. The Service Provider bears no liability for damages, either towards the Contracting Party or towards the person concerned, in connection with such action taken by the Service Provider’s security service.
10.2.4. The Service Provider is obliged to:
- perform the accommodation, catering, or other services ordered under the Contract with appropriately qualified staff, in accordance with applicable regulations and service standards,
- investigate the Contracting Party’s written complaint, take the steps necessary to handle the problem, and document the results of the investigation and the action taken.
The Contracting Party’s contractual rights and obligations
10.3.1. Under the Contract, the Contracting Party is entitled to the intended use of those facilities of the Service Provider that fall within the ordinary scope of the services set out in the Contract and are not subject to special conditions.
10.3.2. The Contracting Party may lodge a complaint regarding the performance of the services provided by the Service Provider during the period they are staying at the place where the service is provided. In accordance with legislation, the Service Provider is obliged, during this period, to handle any entry made in the Customers’ Book, or any complaint delivered to it in writing in a verifiable manner (or recorded by it in minutes), and to inform the Contracting Party of the action taken within 30 days.
10.3.3. The Contracting Party’s right to lodge a complaint ceases once they have left the place where the service was provided, and they may therefore no longer validly invoke defective performance thereafter.
10.3.4. The Contracting Party and/or the Guest is obliged to settle the consideration for the services ordered in accordance with these GTC and/or by the date and in the manner specified in the Contract. The Contracting Party is liable, as a surety liable as a co-debtor (készfizető kezes), for the settlement of any services ordered by it under the Contract at the Guest’s expense.
10.3.5. The Contracting Party is obliged, at all times, to comply with Hella ’91 Kft.’s rules relating to the use of its services and with the provisions of the House Rules in force throughout the entire area of Puchner Kastélyszálló.
10.3.6. Smoking is permitted only in designated areas within the Service Provider’s facilities; any damage arising from a breach of this rule, or from intentional damage, gives rise to a liability for damages on the part of the offender or the party causing the damage.
10.3.7. The Service Provider provides parking for the Contracting Party. Only the Service Provider’s parking spaces may be used by the Contracting Party and its guests, employees and suppliers. If, for any reason, vehicles are parked outside the designated areas, the Contracting Party shall be liable for all resulting damage and costs, including any claims asserted by the owners/users of neighboring properties, as well as the consequences of any police action or fines. The Service Provider assumes no liability whatsoever in connection with parked vehicles.
10.3.8. Costs relating to the storage and transport, before and after the event, of materials and equipment not owned by the Service Provider shall be borne by the Contracting Party.
10.3.9. If the Contracting Party brings high-value items onto the premises of the facilities operated by the Service Provider for the purposes of realizing planned programs, the Contracting Party is obliged to insure these high-value items. The Contracting Party is responsible for the continuous safekeeping of these items. In the event of any damage, deterioration, loss or destruction of these high-value items, the Contracting Party bears full liability. Under no circumstances is the Contracting Party entitled to pass on any resulting damage to the Service Provider. The task of the security guards provided by the Service Provider is solely and exclusively to maintain order at the facility, and does not include securing or guarding high-value items. With reference to this point, the Contracting Party irrevocably declares that it brings high-value items onto the premises of the facility, and keeps them there, at its own risk and responsibility.
Refusal of performance of the Contract, termination of the obligation to provide services
10.4.1. The Service Provider is entitled to terminate the Contract for its services with immediate effect, i.e., to refuse to provide the services, if:
- the Contracting Party, or the Guests, do not use the facility, or the room(s) made available, as intended,
- the Contracting Party fails to fulfill its deposit payment obligation set out in the Contract,
- the Contracting Party fails to provide, by the agreed deadline, or refuses to provide, the information necessary for the contractual performance of the service undertaken by the Service Provider, or otherwise seriously breaches its obligation to provide information and cooperate, causing legal detriment to the Service Provider.
- if the service cannot be performed due to “force majeure”,
- the Guest behaves in an objectionable or rude manner towards the security or order of the accommodation or its employees, is significantly under the influence of alcohol or drugs, or engages in threatening, offensive, or other unacceptable behavior,
- the Guest suffers from an infectious disease.
Liability clause
10.5.1. The Service Provider is liable to the Contracting Party for damage caused intentionally or through gross negligence by the Service Provider or its employees at the place where the service is provided.
10.5.2. The Service Provider’s liability does not extend to damage events that occurred due to an unavoidable cause beyond the control of the Service Provider’s employees, or that were caused by the guests or employees of the Contracting Party themselves.
10.5.3. The Service Provider may designate areas at the place where the service is provided which the Contracting Party’s guests and employees may not enter. The Service Provider bears no liability for any damage or injury occurring in such areas.
10.5.4. The Contracting Party’s guests and employees must immediately report to the Service Provider any damage they suffer, and must provide the Service Provider with all information necessary to clarify the circumstances of the damage event, including, if applicable, for drawing up a police report/conducting a police procedure.
10.5.5. The Service Provider is also liable for damage suffered by the Contracting Party’s guests and employees due to the loss, destruction or damage of their belongings, if the Guest placed them at a location designated, or generally intended for this purpose, by the Service Provider (the safe deposit facility located at the hotel reception), and handed them over to an employee of the Service Provider authorized to receive such items.
10.5.6. The Service Provider is liable for valuables, securities, and cash only if it expressly accepted the item for safekeeping, or if the damage occurred for a reason for which it is liable under the general rules. In this case, the burden of proof rests with the Contracting Party’s guests/employees.
10.5.7. The Service Provider bears no liability for items left behind by the Contracting Party. In the case of items found in the room, pursuant to the Hotel’s confidentiality policy, the Guest may not be notified about a valuable item left behind. Found items are kept by the Service Provider for 2 weeks, during which period the Contracting Party must arrange for a courier to collect it, should they wish to claim it. After the two weeks have elapsed, the Hotel will donate the items to the Red Cross or dispose of them.
10.5.8. The Service Provider will require the person who caused any damage, whether negligently or intentionally, to compensate for it.
10.5.9. Pets may be brought under the following conditions:
- We are only able to accommodate pets that are kept indoors (household pets).
- You must arrange for the animal’s accommodation (dog/cat basket, etc.) and feeding.
- Dogs may be brought into the hotel’s restaurants on a leash. In such cases, please ask our waiting staff for assistance with table reservations. Seating the dog at the table or feeding it in the restaurant is not permitted.
- Pets may not be brought into the castle and palace building (rooms, lounge areas), the bathhouse, the playground, or the outdoor pool and its surrounding area.
- Upon arrival, you must present the vaccination booklet confirming that the animal is healthy and has the appropriate vaccinations.
- Upon arrival, a statement must be signed at reception, undertaking to compensate for any damage caused by the pet.
- To avoid any inconvenience, if the dog requires its owner’s presence, please do not leave it unattended in the room, so that the rest of our other guests is not disturbed. If a complaint is received from another room due to the dog’s behavior, the dog’s owner is obliged to reimburse the compensation determined by the hotel.
- Upon your departure, we will inspect the room, and any damage will be charged to the bill.
Confidentiality
10.6.1. The Parties classify as confidential, and treat as confidential, as business secrets, all data, documentation, and other information (with particular regard to data and information qualifying as business secrets) that comes to their knowledge regarding the other party, or that belongs to the other party’s sphere of interest, during performance of the Contract. Neither party will make confidential information accessible to any third party without the other party’s prior written consent – not including mandatory disclosure to authorities – nor will it bring such information to the knowledge of, or disclose it to, any third party.
10.6.2. In fulfilling its obligations under the Contract, the Service Provider is obliged to act in accordance with the provisions of Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information (“Infotv.”), the relevant data protection legislation, and – to the extent the Contracting Party has brought it to the Service Provider’s attention – the Contracting Party’s relevant internal rules.
Brand protection
10.7.1. The Parties may only use or mention each other’s name or logo for the purpose of promoting or advertising their own economic or commercial activities if the other party has given prior written consent to do so. The Parties are liable for damages in the event of a breach of the obligations set out in this point.
10.7.2. The use of the brand and trademark is strictly prohibited in connection with any radio, television or online marketing or advertising, including the use of the trademark in paid search engine listings, meta tags, as keywords, as links, or by any other means that influence search engine results for internet searches relating to the brand; deviation from this is possible only by mutual agreement of the Parties.
Force majeure
10.8.1. Any cause or circumstance (e.g., war, fire, flood, power outage, occurrence of a strike) beyond the Parties’ control (force majeure) releases the Parties from performing their obligations arising from the Contract for as long as such cause or circumstance persists. The Parties agree to make every effort to mitigate the consequences of such causes and circumstances.
10.8.2. If, due to force majeure or other external, unavoidable cause not attributable to the Contracting Party, performance of the contract becomes impossible, the Contracting Party is entitled to withdraw from the contract without paying a cancellation fee. The Contracting Party is obliged to credibly prove the existence of the force majeure or other cause at the time the withdrawal statement is made. The Service Provider only accepts evidence from public and official sources as authentic (e.g., an official travel restriction issued by the foreign ministry of the given country, or an airline’s flight cancellation notice, which can also be independently verified by the service provider (a third party), etc.).
10.8.3. Illness does not qualify as force majeure!
10.8.4. The hotel accepts cancellations and modifications only in writing. The written cancellation must be received by the specified date.
Other supplementary provisions
10.9.1. The Service Provider accepts the Contracting Party’s HUF 10,000 voucher, due for a corporate event, as follows: A maximum of 2 coupons may be redeemed per room, per reservation, subject to the conditions stated on the coupon. The coupon cannot be combined with any other promotion or discount. The coupon must be presented at reception in its original, non-photocopied form.
10.9.2. The 10% discount granted by the Service Provider to employees of contracted partner companies cannot be combined with any other discount, the hotel’s own promotion, or the Individual Puchner promotion.
10.9.3. The Service Provider accepts the “Kastélyszálloda” voucher issued by Feldobox Kft., but its acceptance is, under the Service Provider’s own internal policy, subject to the following conditions:
- In the case of a weekend reservation (Friday and Saturday nights), a minimum stay of 2 nights is accepted.
- During the peak season (July 1 – August 31), an additional 2 nights must be purchased at the full price alongside one coupon.
- The hotel does not accept the coupon during peak periods. In the event of a cancellation made outside the cancellation period, the Guest is obliged to send the coupon’s serial number so that the Hotel can charge it as a contractual penalty.
10.9.4. Gift vouchers can only be accepted within their expiry date. Vouchers cannot be extended.
